Personal data we process

Combo Solutions, a SAS with share capital of €229,365 whose registered office is located at 26, rue Louis Blanc, 69006 Lyon, registered with the Lyon Trade and Companies Register under number 811 426 584, VAT number FR65811426584 ("We"), as data controller, collects the personal data you submit to us when you use the services we provide (the "Services").  

In addition to the personal data that you submit to us, that is submitted to us, or that we collect automatically. We may combine such personal data with the personal data you submit to us for the purposes described in this Privacy Policy.

The table below (Table 1) details the categories of personal data that are collected as mentioned above and how we use this data when you use our Services, as well as the legal basis on which we process it.

We process this data in order to send you marketing communications about our Services. Our legitimate interest in providing you with information about our Services and news about our activities. This processing may also be based on your consent if your professional activity is not related to our Services.

We may anonymize or aggregate the personal data we collect (so that it is no longer considered personal data) and use data for purposes such as testing our IT systems, research, data analysis and improving the Services (including as part of the dissemination of a construction carbon observatory).

If you choose not to provide the personal data identified as mandatory (which generally means that they are necessary to be able to use the Services or respond to your requests), we may not be able to respond to your requests or provide the Services to you.

In addition to the personal data that you submit to us, that is submitted to us, or that we collect automatically. We may combine such personal data with the personal data you submit to us for the purposes described in this Privacy Policy.

The table below (Table 1) details the categories of personal data that are collected as mentioned above and how we use this data when you use our Services, as well as the legal basis on which we process it.

Retention of personal data

We retain personal data for the time necessary to provide the Services and for the other purposes described in Table 1. We also retain personal data where necessary to comply with our contractual and legal obligations, where we have a legitimate interest in doing so (such as improving and developing our Services, and improving the security and stability of our Services).

We may also retain your personal data in order to defend or enforce our rights, to respond to legal requests, in connection with a merger/acquisition or in order to implement the Contract we have entered into with you.

In any event, we take into account the amount, nature and sensitivity of the personal data, as well as the potential risk of harm resulting from unauthorized use or disclosure of your personal data, in determining how long we will keep your personal data.

In the event of withdrawal of consent (where consent is the legal basis for processing, as described in Table 1) or upon expiry of the retention period for personal data collected for the purposes referred to in Table 1, the personal data concerned will be automatically deleted or rendered permanently anonymous.

As part of a business transaction or reorganization. We may take part in or be involved in a business transaction, such as a merger, acquisition, financing, sale of assets, etc. As part of the negotiations for such a transaction, we may disclose personal data to third parties. As part of the negotiation of such a transaction, we may disclose personal data to third parties. Personal data may also be disclosed in the context of insolvency, liquidation, reorganization or similar proceedings. Such processing is carried out on the basis of our legitimate interest in administering Combo Solutions, SAS at various stages of its development.

 

To comply with legal obligations or enforce our rights: We may disclose personal data to third parties, such as legal advisors and authorities: 

  • to establish, exercise or defend legal claims; 
  • to comply with our legal obligations; 
  • to assert our rights and, in particular, to enforce the terms of the Contract we have entered into with you;
  • to prevent, identify or stop fraud. 

Such processing is also carried out on the basis of our legitimate interest in asserting our rights and complying with legal obligations.

- With the consent or instructions of the persons concerned: We may disclose personal data concerning an individual to certain other third parties or publicly with their consent or according to their instructions.

Transfer of personal data

In the event that your data is transferred outside the European Economic Area, we will ensure that: (i) personal data is transferred to countries recognized as offering an equivalent level of protection; or (ii) the transfer is made in accordance with appropriate safeguards, such as the standard contractual clauses adopted by the European Commission (including the additional safeguards recommended by the European Data Protection Board). 

- Adequacy decisions in accordance (Article 45 of the RGPD): the European Commission has found that certain countries outside the European Economic Area adequately protect personal data. 

- Standard contractual clauses (Article 46 of the RGPD): the European Commission has also adopted standard contractual clauses, which provide safeguards for personal data transferred outside the European Economic Area. We may use these standard contractual clauses in the case of a transfer of personal data to a country outside the European Economic Area that has not been deemed to adequately protect personal data.

Your rights with regard to your personal data

You have the following rights with respect to your personal data (subject to certain limitations provided by law):

Deletion You have the right, in certain circumstances, to ask us to delete your personal data within a reasonable period of time if the continued processing of such personal data is not justified.
Portability You have the right, in certain circumstances, to receive a copy of the personal data you have provided to us in a structured, commonly used and machine-readable format, which allows its re-use, or to request the transfer of your personal data to another person.
Withdrawal of consent There are certain circumstances in which we need your consent to process your personal data. In these cases, and if you have given your consent, you have the right to withdraw it. If you withdraw your consent, this will not affect the lawfulness of our use of your personal data prior to your withdrawal.
Opposition You also have the right to object to any processing based on our legitimate interests where there are grounds relating to your particular situation. If there are compelling reasons to continue processing, we will keep you informed. You may object to marketing activities for any reason.
